Terms of Service

Please read these terms carefully before making any purchases from Ace Music Academy. Your access to Ace Music Academy is conditioned on your acceptance of and compliance with these terms. These Terms apply to all visitors who access Ace Music Academy and all clients who purchase any products or services from Ace Music Academy.

 

Purchases and Auto-Pay

  • If you wish to purchase any product or service made available through Ace Music Academy, you may be asked to supply certain information relevant to your purchase including, without limitation, your first and last name, your phone number, and your email address.

  • for all music lesson purchases and auto-pay billing plans, a processing fee of $1.50 will be applied. A $2.50 processing fee will be applied to all instrument rentals.

Late Fees / Unpaid Charges

  • For lessons that are provided on a monthly basis, If there is an overdue balance for more than 7 days, a grace period of 3 days will be provided to process your payment and credit the late fee. Once the grace period has ended, a card on file will be charged with late fees included (for any concerns regarding the safety of your credit card information, please refer to the privacy policy).

  • Any lessons that are not paid by their respective due date will incur an additional $5 penalty late fee for every week that the lesson(s) remain(s) unpaid. One of the purposes of your credit/debit card information being provided during registration is to help you avoid a continuation of this penalty fee for late payments (for any concerns regarding the safety of your credit card information, please refer to the privacy policy). If the card on file does not process successfully, we will attempt to contact you to fix the issue. If we are not able to resolve the processing of the card on file, then all services will be stopped and you will continue to accrue penalty late fees until you have paid the accrued amount owed in full.

Classes

When you sign up for any classes provided by Ace Music Academy, you will be asked to register through our registration page. Once registration is submitted, you will be agreeing to the following terms:

  • Starting in January 2024, all students will be enrolled in a recurring annual registration fee of $25. This fee is mandatory for continued enrollment with Ace Music Academy.

  • Students who are late for a lesson will not be guaranteed their full lesson time. We do guarantee the full lesson time if the teacher is late.

  • Lessons that are paid on a weekly basis are required to be paid prior to the lesson being taught. Lessons that are paid on a monthly basis (4 or 5 lessons) however are due by the 7th of the month.

  • All recital performances are required to be paid for prior to the student's performance ($25 fee).

  • For lessons with underage children (students ages 17 and under), at least one parent or guardian (18+) has to accompany the child and deliver her/him to the teacher in the lobby, and receive the student in the lobby after the lesson is complete. AMA will not be responsible for your children before and after the lessons. Teachers will not accompany the students outside to the parking lot. There will be no exceptions to this policy, which applies to all lessons and classes provided by Ace Music Academy.

Lesson Cancellations / Rescheduling / Make-Up Lessons / Refunds

  • For any cancellations made on the day of the scheduled lesson without prior notification, 50 percent of the class fee will be charged and collected on the same day. If a student cancels before the end of the day prior to the scheduled lesson, there will be no cancellation fees.

  • When a lesson is canceled properly, students are required to re-schedule and attend a make-up lesson that must be rescheduled within 30 days of the planned absence. Failure to make up a canceled lesson will void any associated discounts.

  • If you cannot attend a regularly scheduled lesson with the Academy Director due to a planned absence, then you must reschedule a make-up with a substitute instructor within 30 days of the planned absence. If the make-up lesson has not been rescheduled within 30 days, you will be liable for the payment of the missed lesson.

  • If you are unable to attend a scheduled make-up lesson, it will be considered paid unless it was missed due to an unforeseen emergency.

  • Refunds are not provided for registration or pre and post-paid services of any kind that are provided by Ace Music Academy. If you have services that are pre-paid but you wish to discontinue, then you will still be considered active with Ace Music Academy until all of the prepaid services have been rendered to you. Once all of the pre-paid services have been provided, then you will become “inactive” until you start receiving services again.

  • Any tangible retail products that are purchased are entitled to a refund within 7 days of making the purchase. If the product is not returned with all of the original packaging and all accessories associated with it, then no refund will be provided.

Rentals

Any renter agrees to abide by these terms and conditions:

  • Return: Instruments must be rented for a minimum period of 3 months. All fees for the initial 3 month rental period are due at the beginning of the initial 3 month rental period and must be charged to a valid credit card. This initial payment is non-refundable, even if the renter decides to return the instrument before the end of the initial 3 month rental period expires. After the initial 3 month period, the agreement will be converted into a monthly Rental Agreement. The renter may return the instrument to Ace Music Academy at any time thereafter. The agreement will then be cancelled, provided all fees have been paid up to the date of return.

  • Rental Purchase Option: We will apply 100% of your first 3 months’ rent (excluding maintenance fees and taxes) toward the purchase of the rented item, or toward the purchase of any other similar instrument that is available of equal or greater value. This special offer applies only if that item is purchased immediately at the end of the initial 3 month rental period. If you choose to continue renting for a longer period, 50% of your accumulated rental payments (excluding maintenance fees and taxes) may be used toward the purchase of the rented item or toward another similar instrument of equal or greater value. Rental credit stops accumulating after the first 12 months. The renter agrees to forfeit any accumulated purchase credit when failure to pay or return a rented instrument occurs.

  • Late Charge: When doing the monthly rental option (after the initial 3-month period), if a rental payment is not received within 7 days after it is due, a $5 late fee will be applied. Late fees do not add to Renter’s equity for the rental purchase option.

  • Credit Card Authorization: If the renter is more than 10 days delinquent, Ace Music Academy is authorized to submit a credit card charge for rental amount due to the renter’s card on file, plus any late fee(s) due. If the renter is declared in default of this Agreement as outlined herein, owner is authorized to submit a charge for the total sums owed under this Agreement including any remaining balance due to purchase the equipment plus any late fees. If owner takes possession of the equipment, a credit card charge will be submitted to the renter’s credit card for any past due payments.

  • Default: Owner can declare a renter to be in default if (i) renter fails to pay a scheduled rental payment and late charge within 25 days after the due date of the scheduled rental payment. (ii) Renter provided inaccurate or misleading information on this agreement, (iii) any other circumstance that owner feels endangers the safety of the equipment. If owner declares a renter to be in default, the equipment must be returned to owner within 24 hours or it will be subject to repossession. Failure to return the rented equipment to owner in the event of default at their request may constitute under the laws of Florida state, an act of theft which is considered a felony punishable by fine or imprisonment.

  • Repossession: If owner declares a renter to be in default of this Agreement, owner is entitled to repossess the equipment according to the State of Florida and Federal law. If owner takes possession of the equipment, it is agreed that this agreement shall terminate and there shall be no further responsibility on either party with the exception that the renter will be liable for past due payments. Renter will also be responsible for any collection fees associated therewith.

  • Replacement Coverage (Loss/Damage): Renter is responsible and liable for the loss or damage of the rented equipment other than the ordinary wear and tear. In the event of loss or theft, or damage beyond repair of rented equipment, renter will be responsible for compensating owner in an amount equal to the Retail Purchase Price of the equipment in question, less any applicable rental payments. Owner will subsequently provide a replacement instrument of equal quality. If there is a loss of the rental equipment the renter is responsible for filing a police report within 24 hours of the loss, and contacting the owner within 48 hours. Renter is still liable for the rental equipment if it is lost, and must pay the remaining balance of the rental (Rental Retailed Price Minus Rental Credit).

  • Repair and Maintenance: Owner will make the appropriate adjustments to keep the equipment in proper playing condition at the cost of the renter, and only if the renter is current in their rental payments. This does not include the restoration of finish, willful damage, careless handling, cleanings or replacement of expendable accessories such as but not limited to strings, rosin, reeds, ligatures, etc. The renter is responsible for the cost of maintenance and servicing the rental equipment.

  • Loaner: In the event that the rented equipment needs to be returned for repairs taking more than 3 working cards, a loaner may be provided by owner, free of charge (subject to availability).

  • Size Upgrade: Owner will exchange a rental instrument for the next size up at any time. Renter will retain all accumulated purchase credits.

You further acknowledge and agree that Ryan Ace Music shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

 

Donations

Donations will appear as "RAM FDN Donation" on your billing statement. Donations of any quantity will be charged to the credit card you entered when providing the donation. All donations must be authorized by the donor.

Recurring Donations The Ryan Ace Music Foundation currently offers monthly recurring donations at $5, $10, $20, $50, or $100 price-points. Any of the price points you choose will be charged to the credit card you entered when subscribing to donate. All donations are authorized when subscribing. You can unsubscribe at any time by contacting Ryan Ace Music at the information below.

 

Changes

Ryan Ace Music reserves the right, at sole discretion, to modify or replace these Terms at any time. If a revision has been decided, we will try to provide at least 14 days notice prior to any new terms taking effect. What constitutes an approved revision will be determined at our own discretion.
